What Happens When an Algorithm Inspects Every Photo You Upload?
The next time you drop a photo into a group chat or post it to a forum, picture a machine looking at it first. In South Korea, a proposal to make AI mandatorily scan every image uploaded to online communities is back on the table. The stated goal is to wipe out non-consensual intimate imagery and child sexual abuse material. The problem is that the net being cast is enormous.
Let me be upfront: this isn’t a topic that’s been blowing up across forums in the last month. But it’s close enough to technically and legally feasible that it’s worth mapping the fault lines before the fight actually starts.
Why This Is Resurfacing Now
The groundwork is already laid. Since 2021, Korea has required internet operators above a certain size to filter illegal imagery — a law nicknamed after a notorious digital sex crime ring that ran exploitation chat rooms. Even then, the pre-screening debate was fierce.
What’s being floated now goes a step further. Instead of just a handful of large platforms, the vision is for AI to automatically inspect essentially every image posted to essentially every community. As the technology has matured, the simple fact that “it can be done now” has become the justification for doing it.
What an AI Scan Actually Looks At
Here’s where the conversation usually goes sideways, because “AI scanning” describes two very different things.
The first is hash matching. You take known illegal images, generate a digital fingerprint for each, store those fingerprints in a database, and check whether new uploads match. The system never understands what’s in a photo — it only compares fingerprints. This is roughly how Apple’s abandoned CSAM-detection plan and the industry’s PhotoDNA tools work, and the privacy footprint is comparatively small.
The second is content analysis. Here the AI looks at the image itself and renders a judgment: this looks like pornography, this looks violent. The upside is that it can catch brand-new illegal material that isn’t in any database. The downside is that a machine is now reading the contents of every single photo.
These two approaches are worlds apart. Depending on which one a mandate requires, you either get a targeted tool or a surveillance backbone.
The Free-Speech Camp’s Fears
The core objection is prior restraint. Constitutions generally forbid censoring expression before it’s published. If a machine inspects your image before it ever goes live, critics argue, that’s prior restraint by another name.
The technical limits cut deep too. AI doesn’t grasp context. Medical education material, fine art, breastfeeding photos, even evidentiary images documenting abuse — all can get flagged as false positives. This isn’t hypothetical. There have been well-documented cases abroad of parents who photographed a child’s rash to send to a doctor, only to have the platform’s automated system flag the account and loop in police.
The deeper worry is the infrastructure itself. Once a system that inspects every image in real time exists, the list of things it inspects for can quietly grow. Today it’s illegal imagery. Tomorrow, what? The technology is neutral. Whoever holds the switch is not.
The Case for Doing It Anyway
The other side isn’t making a weak argument. Digital sex crimes are happening right now, and once an image spreads, pulling it back completely is nearly impossible. For a victim, “block it before it spreads” can feel like the only real remedy.
The existing report-and-takedown model is always a step behind. By the time something is reported, reviewed, and deleted, the image has been copied hundreds of times. Automated AI scanning is appealing precisely because it can shrink that lag toward zero.
In the end, this is a head-on collision between two values neither side can give up: safety and freedom.
The Questions That Actually Matter
This is why “are you for it or against it” is the wrong frame. The questions worth pressing are specific.
Does the scan only do hash matching, or does it analyze content? Where are the results stored, and who can access them? Is there an appeals process when something gets wrongly blocked? Who decides what goes into the database in the first place? And when someone later wants to expand the system’s scope, what stops them?
Mandate scanning without clear answers to those, and you’ve built something closer to a surveillance grid than a tool against digital sex crime.
The technology is ready. What’s left to decide is the constraints we put on it. The moment we accept a system that inspects every photo, what exactly are we getting, and what are we handing over? That’s the trade. The only real question is whether you’d take it.
